This agreement is between the Client/Model, whose name and address is filled in the previous form, and the Photographer, Simona Graszl.
1. Model Release
I hereby give to Photographer the absolute and irrevocable right and permission with respect to the photographs in which he/she may be included with others:
a) To copyright the same in the photographer’s name;
b) To use, re-use, publish and re-publish, separately or in conjunction with other photographs, in any medium now or hereafter known, and for different purpose including, promotion, advertising and blog.
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
2. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client/ Model will be
responsible for themselves and their minor children and release Photographer from any claims against their person or their business.
3. Copyright & Penalty
Photographer retains all copyrights to all images created during Client/ Model session. A print release will be given with digital files to print images for personal use after purchasing* files. The print release does not allow publication of your Pictures (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.
It is illegal to copy, scan, download, print, share, alter, or otherwise take any images created by Photographer during photo session that you didn't purchase.
This applies to blogposts, Facebook, or hard copy images.
If Client/Model takes images via any method listed above, or any other method, Client/Model will be invoiced for the cost of each digital image client has taken, at photographer’s current price per digital file.
*The way and amount of your purchase is discussed and confirmed beforehand.
4. Licensing Notice
The images that are being provided to Client/ Model are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and web publishing. Clients/ Models license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
Client/ Model of the original files releases Photographer from any liability due to loss or damage of the images, and also releases Photographer from any obligation to maintain copies of any digital file, image, or photograph.
Photographer may revoke this license at any time and for any reason. Photographer retains all copyrights to the images and derivative works thereof.
If Client/Model is posting any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram etc.) OR if they share any digital files from either Facebook or my website, you may not alter the image in any way and you must give credit to Year in a Life or Simona Graszl.
5. Retainer, Rescheduling, Late Arrivals & Cancelling
When reserving a session, a €50 none refundable reservation fee applies, which will be deducted from your overall purchase.
In the event that the Client/Model requests to reschedule a session, notice must be given at least 48 hours prior to the scheduled event.
The rescheduling must be within the same month of the original scheduled session. Reschedules can be made for emergencies, weather, sickness, and unforeseen circumstances.
Late arrivals will have the time deducted from their session slot if no time is available. If the Client/Model without any notice is 20 minutes late, Client/Model looses their spot and the reservation fee they made to Photographer will not be refunded.
If the Client/Model doesn’t show, or cancels 24 hours prior to session they will loose their spot and the reservation fee.
6. Orders and payment
The order of your goods must be placed at the viewing appointment after the shoot. Client/Model may reorder 14 days after the viewing appointment.
The order placed on the viewing appointment cannot be changed after that. Even if the Client doesn't want the goods they ordered any longer, they will still be invoiced for the original order.
Payments have to be made strictly 14 days from date of invoice to Simona Graszl via bank transfer or PayPal.
No goods will be delivered until the payment is made in full. The session fee will be invoiced even if the Model/Client doesn't want to order any additional images or products.
A fee of €5.00 may be made for each account reminder, duplicate invoice, or any other paperwork, correspondence or phone calls involved with the pursuing of a debt. This fee is non-refundable, and represents the additional time spent pursuing overdue invoices. After the second reminder the Photographer will forward your information to a collection agency, any further costs will be payed by the Client/Model and are not refundable.
7. Failure to Perform
The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the location.
The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. It is acknowledged that any lists submitted to the Photographer will be used for organizational purposes only and in no way represent photography that will actually be produced. The Photographer will do its best to fulfill all requests but can make no guarantees all images will be delivered.
The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer.
